Subject:  Response to issues related to liquor licenses in the community.

 

 

Procedure and Responsibilities

The Liquor License Chairperson and committee members are responsible to oversee the administration of this policy.

 

Policy

 

Whenever the owner or president of a current or perspective liquor license holder seeks in writing the support of CCA for a license transfer or renewal or a zoning change related to the use of alcohol the association shall consider the request.  The association will take a for, against or neutral position on the issue.  The exact steps taken will depend upon the time constraints of the hearing date but when feasible include the following:

 

  1. The Chairperson invites the Tavern/Restaurant Owner to meet with the Committee for a preliminary evaluation.  The Committee attempts to resolve any issues that it believes may have a negative impact on the community.

 

  1. The Committee provides a report with a recommendation to the Board. The Board takes a formal vote that will be presented to the full membership at the next public meeting.

 

  1. The Tavern/Restaurant Owner is invited to attend the public meeting to present their case. Prior to a general vote, the President will present the Board’s recommendation.  By a simple majority, a final determination will be made either for, against, or a neutral position for this license. The association may adopt a position in favor of the license with the requirement that stipulations or conditions be met.

  3. An official letter with the President’s signature will be sent to the appropriate agencies.

 

The feasibility of the above stated steps will be the sole determination of the Officers of the Association.

 

If the owner or president of a current or perspective liquor license holder does not approach CCA but the association learns of a hearing, the CCA may follow whichever of the above procedures are feasible within the time constraints of the hearing date as determined by the Officers of the Association.

 

Any decision reached by the CCA, for, against or neutral on a proposal shall apply to all Liquor Board, Zoning Board and other administrative or legal hearings required for that proposal.  A community resident and CCA member will be appointed as lead in attending the hearings and reporting back to the board and Liquor License Committee.

 

The above policy is not retroactive.  The above policy applies to CCA official positions and does not prohibit any CCA member from dealing with these issues as they see fit on an individual basis, provided they do not represent themselves as speaking for CCA.
